Terms and Conditions
1. Acceptance of these terms
These Terms and Conditions ("Terms") govern your access to and use of the CallaTool mobile application and this website (together, the "Platform"), operated by CallaTool ("CallaTool", "we", "us", "our"). By creating an account, browsing the Platform, posting a job, submitting a quote, or placing an order in our workwear store, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
Where you register or use the Platform on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. About CallaTool
CallaTool is a marketplace platform that connects customers who need trade work done ("Customers") with independent tradespeople who offer trade services ("Tradespeople"). CallaTool also operates an online store selling branded workwear and accessories.
CallaTool is not a trade business, employer, staffing agency, or contractor. We provide the technology that lets Customers and Tradespeople discover each other, communicate, exchange quotes, and manage jobs - the trade work itself is performed entirely by independent Tradespeople, not by CallaTool.
3. Eligibility & accounts
- You must be at least 18 years old and able to form a legally binding contract to create an account.
- You agree to provide accurate, current and complete information when registering, and to keep your account, job, location and profile information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- One account is intended per person; every account starts with Customer capability, and Tradesperson capability can be added later without needing a second account.
- You may request deletion of your account at any time from the Account section of the app.
4. Using the platform
Customers may browse nearby Tradespeople, post job requests, request quotes, message Tradespeople, and leave reviews after a job is completed. Tradespeople may build a profile, set a service area and call-out fee, respond to nearby job requests, submit quotes, and manage jobs through to completion.
You agree to use the Platform only for its intended purpose of arranging and completing genuine trade work or genuine store purchases, and not to use it to harass, defraud, or mislead other users.
5. Jobs and quotes
CallaTool helps Customers and Tradespeople connect - the specific scope, price, call-out fee, schedule, workmanship standard, materials, and outcome of any job are agreed between the Customer and the Tradesperson through the Platform. CallaTool provides the marketplace, payment processing, records, review and dispute-support tools, but does not itself perform the trade work and does not guarantee the quality, safety, timeliness, or outcome of any job.
Quotes submitted through the Platform should clearly set out labour, materials, call-out fees, minimum job fees, travel charges, emergency premiums, applicable warranties, and any exclusions. Both parties are encouraged to keep job-related communication on the Platform so there is a clear record if a dispute arises.
6. Tradesperson contract terms
When you add a Tradesperson profile, you separately accept the following additional contract terms. CallaTool will email you a PDF copy showing your name, registered email, service details, acceptance date, and terms version.
- You are an independent contractor. You are not an employee, agent, partner, franchisee, or representative of CallaTool.
- CallaTool provides the platform for discovery, quotes, messaging, payment processing, records, reviews, and dispute support. You provide the actual trade service independently.
- All payments for work sourced, quoted, arranged, accepted, messaged about, or completed through CallaTool must be paid through the CallaTool platform. This includes deposits, call-out fees, labour, materials, variations, emergency fees, cancellation charges, and repeat work arising from the platform relationship.
- You must not ask Customers to pay by cash, EFT, private invoice, card machine, WhatsApp-only booking, another marketplace, or any off-platform method unless CallaTool gives prior written approval.
- CallaTool may deduct platform commission configured by CallaTool, payment processing fees, refunds, chargebacks, penalties, customer credits, taxes required by law, and other disclosed amounts before settlement.
- You are responsible for your own taxes, VAT or other applicable sales tax, permits, licences, registrations, insurance, tools, vehicles, materials, employees, subcontractors, and safety compliance.
- You must keep your profile accurate, including name, business name, photo, categories, qualifications, call-out fee, emergency status, service area, portfolio, and contact details.
- Emergency availability must only be enabled when you can respond quickly. Repeated no-shows, cancellations, late arrivals, or false emergency availability may affect ranking or account status.
- Quotes must clearly explain labour, materials, call-out fees, minimum job fees, travel, emergency premiums, warranties, exclusions, and timing. Variations should be recorded through the platform where reasonably possible.
- You are responsible for workmanship, materials you supply, property damage, injury, legal compliance, and the conduct of your employees, helpers, or subcontractors.
- You must communicate respectfully and keep job discussions, scheduling, payment requests, cancellation discussions, and dispute information on the platform where possible.
- You must not post fake reviews, buy reviews, review yourself, copy portfolio work, impersonate another person, misrepresent qualifications, or pressure customers for misleading feedback.
- You must protect customer personal information and only use it for the specific job or platform purpose for which it was provided.
- CallaTool may request verification documents and may limit, suspend, deactivate, or terminate access for fraud, unsafe conduct, poor service, circumvention, unlawful activity, document issues, repeated complaints, or breach of terms.
- CallaTool may update these terms by notice in the app or by email. Continued platform use after notice means you accept the updated terms.
7. Payments and provider status
Tradespeople and other service providers using CallaTool are independent contractors and are not employees, agents, or representatives of CallaTool. All payments for jobs, deposits, call-out fees, labour, materials, variations, emergency work, cancellation charges, quotes, and related services arranged through the app must be paid through the CallaTool platform unless CallaTool gives prior written approval for another payment method.
When a job is marked completed, CallaTool may create a completed-job payout ledger entry showing the gross job amount, platform commission, payment processing fee, net amount payable to the Tradesperson, payout status, and payout date where applicable. The net amount is the amount payable after deductions, subject to fraud checks, dispute checks, refund or chargeback risk, verification requirements, and payment-provider processing.
CallaTool may place payouts on hold, reverse pending payouts, deduct refunds or chargebacks, offset platform debts, or delay settlement where a job is disputed, a payment is not confirmed, a safety or conduct report is under review, fraud is suspected, customer evidence is required, or law or payment-provider rules require it. Payout schedules and commission rates may be updated by notice in the Platform or by written policy.
8. Workwear store terms
The CallaTool website includes a store selling branded workwear and accessories ("Store Items"). The following terms apply specifically to the Store:
- Prices are shown in South African Rand (ZAR) and may change without notice. The price shown at the time you submit an order enquiry is the price we will honour, subject to availability.
- Product images, colours and swatches are representative and may vary slightly from the item you receive.
- Submitting the "Enquire to order" form or emailing us about a Store Item is an order enquiry, not a completed purchase. No payment is collected automatically through the website - our team will contact you to confirm size, quantity, stock availability, delivery details, and arrange payment separately.
- We reserve the right to decline or cancel an order enquiry, including where an item is out of stock, priced in error, or where we cannot verify the order details.
- Delivery timeframes and shipping costs (if any) will be confirmed with you directly before payment is taken.
- Once payment has been arranged and confirmed, standard consumer protections under South African law (including the Consumer Protection Act 68 of 2008, where applicable) apply to your purchase.
9. Reviews and content
Reviews may only be submitted by a Customer for a job that was completed through the Platform with that Tradesperson. Reviews must be honest and based on genuine experience. You must not post, and must not ask others to post, fake, incentivised, or self-authored reviews.
You retain ownership of content you submit (such as profile photos, portfolio images, and messages), but you grant CallaTool a licence to host, display, and use that content as reasonably necessary to operate and promote the Platform.
10. Prohibited conduct
You must not use the Platform to:
- Post false, misleading, abusive, unsafe, illegal, or defamatory content;
- Harass, threaten, or discriminate against another user;
- Circumvent the Platform to avoid fees, verification, or dispute records;
- Impersonate another person or misrepresent your qualifications, identity, or affiliation;
- Interfere with, reverse-engineer, or attempt to disrupt the Platform's normal operation; or
- Use the Platform for any unlawful purpose.
We may investigate suspected violations and take action including warnings, content removal, and account suspension or termination.
11. Verification and safety
CallaTool may request supporting documents from Tradespeople for verification purposes and may display a verification badge where appropriate checks have been completed. Verification reflects the documents and information provided to us at a point in time - it is not a guarantee of a Tradesperson's ongoing conduct, workmanship, or compliance, and Customers should exercise their own judgement when engaging any Tradesperson.

12. Intellectual property
The CallaTool name, logo, app, website design, and underlying software are owned by CallaTool or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent, other than as reasonably necessary to use the Platform for its intended purpose.
13. Third-party links and services
The Platform may link to third-party services, including app stores, payment processors, and mapping providers. We do not control and are not responsible for the content, policies, or practices of third-party services. Your use of those services is subject to their own terms.
14. Disclaimers and limitation of liability
The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. CallaTool does not warrant that the Platform will be uninterrupted, error-free, or that any Tradesperson's work will meet a particular standard.
To the fullest extent permitted by law, CallaTool will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform, any job performed by a Tradesperson, or any Store Item, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold CallaTool harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or the rights of a third party.
16. Termination and suspension
You may stop using the Platform, or request deletion of your account, at any time. We may suspend or terminate your access to the Platform, with or without notice, where we reasonably believe you have breached these Terms, engaged in fraudulent or unsafe conduct, or where required by law.
17. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform will first be addressed through good-faith direct engagement between the parties via our contact page, and failing resolution, may be submitted to the courts of South Africa having jurisdiction, or, where applicable and agreed by both parties, to arbitration or an alternative dispute resolution process.
18. Changes to these terms
We may update these Terms from time to time by posting a revised version on the app and/or this website and updating the "Last updated" date above. Where changes are material, we will provide additional notice, such as an in-app message or email. Continued use of the Platform after changes take effect means you accept the updated Terms.
